The French version takes precedence in the event of any difficulties of interpretation.
I- PAyMENT
Sales are expressly concluded in return for immediate cash payment.
Buyer’s premium: 20% (inclusive of all taxes).
Cheques drawn on a foreign (non-French) bank will only be accepted by prior agreement of SAS Ventes aux Enchères Vendôme-Cheverny-Paris (‘the Auction House’). To arrange this, buyersare asked to obtain, prior to the auction, a letter of credit from their bankfor the approximate amount of their intended expenditure, to be forwarded tot he Auction House no later three days before the sale.
In the absence of such anarrangement, clients who are not French residents cannot take delivery of their purchases before payment is made via SWIFT funds transfer.
If the buyer fails to pay in full within the thirty days following the sale, the seller can request that the goods be resubmitted for auction within three months, at the expense of the defaulting bidder (‘revente sur folle enchère’). The latter must bear the cost of any unfavourable difference inprice between their bid at the initial auction and the price obtained at thesecond auction, as well as all costs incurred by second auction. No advantagecan be drawn from any favourable difference in price at the second auction,which shall be wholly payable to the seller.
No reimbursement can bemade for amounts paid by the buyer before the seller and SAS Ventes auxEnchères Vendôme-Cheverny-Paris have settled all amounts owing to them. There-submission of goods for auction following the default of a bidder in no wayprevents the sellers and SAS Ventes aux Enchères Vendôme-Cheverny-Paris takinglegal action for damages against the defaulting bidder.
II-export LICENCE
The process of obtaining anexport licence can take 5 to 10 weeks, a period which can be significantlyreduced by the buyer’s prompt communication of its instructions to the Auction House, which cannot be held responsible for either the delay or the decision.
Purchases and Deliverieswithin the EEC
Buyers subject to EEC regulations (citizens of an EEC member country) must provide the auctioneer with their VAT identification number as well as the shipping details for the purchased items according to the thres holds current on the day of sale.

IV- GENERAL Information
1- BIDDING
Bids are made using a numberedpaddle, which can be obtained prior to the auction upon registration of theapplicant (proof of identification may be required) and the deposit of a blanksigned cheque made out to SAS Vente aux Enchères Vendôme-Cheverny-Paris.
The paddle number of thelast bidder will be called by the auctioneer.
2- COMMISSION BIDDING
Any bidder not able toattend the auction can complete the commission bid form. ROUILLAC Auction Housewill act on the bidder’s behalf according to the instructions provided on theform, in order to try to purchase the specified lot(s) at the lowest possibleprice and not under any circumstances exceed the maximum bid amount indicatedby the bidder.

No commission bid will beregistered without providing proof of identification and bank guarantees. Ifthere is any doubt with regards to identity or guarantees, ROUILLAC AuctionHouse reserves the right to refuse a commission bid. ROUILLAC Auction Housedisclaims all liability in the event that a commission bid is omitted orincorrectly executed.
3-TELEPHONE BIDDING
Allrequests to bid via telephone are subject to the low auction estimate of thelot. No telephone bid will be accepted for lots estimated at less than €150.
Because physical presence at an auction is the standard form of bidding,ROUILLAC Auction House and its experts accept no responsibility in the event oferror, omission or difficulty in executing any written or telephoned commissionbid.
4-LIABILITY
In the event of a doublebid which is confirmed as such by the auctioneer, the lot will be resubmittedfor sale and all interested parties present may bid against each other in this second auction. All items or paintings are sold by the auctioneer and, ifrequired, by the assisting expert, according to the specifications indicated inthe catalogue and taking into account any corrections announced at the time thelot is presented and recorded in the sale report.
Compensation cannot beclaimed for restorations, defects and accidents, all items being exhibited toallow for inspection beforehand. No warranty is offered as to the condition ofmarbles or frames. With regard to paintings, the specification “oil” isguaranteed, but the support may be board, cardboard or canvas. The remountingof a painting is considered to be a conservation measure and not a fault. Thedimensions, weight, origin, period, and provenance of an item are given as aguide only.
All lots are sold without any form of guarantee: they are sold as is, in the condition they are found in, the series of exhibitions prior to the auctions allowing buyers to form their own opinion as to the condition of items. This offers in particular anopportunity to check that each lot matches the catalogue description, thisdescription being only a guide and implying no liability what so ever.
5- COLLECTING PURCHASES
If paying by non-certifiedcheque from a French bank, delivery of items shall be deferred until the funds are cleared. From time of the fall of the hammer, the successful bidder bears sole responsibility for the purchased item. All items must without exception beremoved the evening of the day of sale, buyers are advised to provide detailed instructions in writing regarding the delivery of their purchases, subject to the discharge of their bought note.
Lots that have not been collected before midnight of the day of sale will be removed and stored in the Auction House’s storage facility in Vendôme. Transportation and storage costs will be borne by the buyer. It is the buyer’s responsibility to insure his orher purchases, ROUILLAC Auction House accepting no responsibility for damage caused to the item from the time the hammer falls.
All administrative processes and transportation are at the buyer’s expense and remain his or her exclusive responsibility.
V-TransportATION AND storage
Please inform us of your intentions concerning transportation and security arrangements for your goods as soon as you have made your purchase.
ROUILLAC Auction House is happy to offer advice and assistance for organising security or shipping of your goods anywhere in France or abroad. Buyers can also organise shippingthemselves with their own carriers.
The buyer is responsible for the transportation, packaging and security of goods after sale. ROUILLAC Auction House accepts no responsibility after the fall of the hammer, inparticular with regard to damage caused during transportation, and may refuseto ship items deemed to be too fragile.
1- VENDÔME-PARIS SHUTTLE
A shuttle shipping service is operated each week between Vendôme and Paris. The following rates, excluding taxes, are offered asa guide only, and must be confirmed with the carrier working with our Auction House:
2- PACKAGING
Because most carriers (UPS, FEDEX, LA POSTE...) do not offer to package items for shipping themselves, a flat fee will be charged of€20 + VAT per lot for packaging small items and €50 + VAT per lot for packaging large items.
Fragile items (ceramics, glass) require special packaging. Extra chargessupplied on request.
3- SHIPPING WITHIN FRANCE AND EUROPE
The following fees are given as a guide only, for non-fragile items with a total size no greater than 150 cm and weighing lessthan 30 kg. All packages are sent via R3-level registered post with record ofdelivery.

4- STORAGE
ROUILLAC Auction House can put you in touch with a specialist storage facility in Vendôme.
Sold items are kept free of charge for two weeks following the sale. After 10working days, storage fees of €4 + VAT per day and per lot will be charged, plus additional insurance fees relative to the value of the item.
